Terms and Conditions of Use
SPES REX · closed beta · version of 14/10/2026
This is an English translation provided for convenience. The Spanish version (Términos y Condiciones de Uso) is the only binding text and prevails in case of any discrepancy.
These terms govern the use of SPES REX (shown as «SPES RE» in the beta). To enter the beta you must accept them, together with the Privacy Policy, by ticking the box on the access screen. If you do not agree, do not use it.
1. Who provides the service
The service is provided by Carlos V. Castrillo, domiciled at Av. Alicia Moreau de Justo 1150, office 306 A, Autonomous City of Buenos Aires, Argentina (hereinafter, «SPES»). For any matter concerning these terms: legal@spesjur.com.ar.
2. What SPES REX is
It is a software tool that assists lawyers in assessing and preparing the federal extraordinary appeal (recurso extraordinario federal) before the Supreme Court of Justice of Argentina, and the complaint (queja) against its denial. In this beta it works only in that mode. It works with artificial intelligence models from an external provider (see section 9).
- It does not provide legal advice to the public, does not act as counsel for or represent anyone, and does not replace the lawyer's judgement.
- Everything it produces is a draft. The analysis, the admissibility assessment and the draft brief are working material that you review, verify, correct and, if you decide to file it, sign under your sole professional responsibility.
- The tool can be wrong: it may omit a requirement, misread a fact, or cite something that does not exist or does not say what is attributed to it.
3. No promise of result
SPES undertakes to make the tool available to you with diligence, regardless of the success of what you do with it (art. 774, para. a, of the Argentine Civil and Commercial Code). SPES does not promise or guarantee that the appeal will be granted, that the complaint will succeed, that the Court will not dismiss it by merely invoking art. 280 of the National Code of Civil and Commercial Procedure (CPCCN), or any other result.
4. Who may use it
- Only lawyers with a current licence to practise, for their professional practice. By accepting these terms you declare that this is the case.
- SPES may at any time ask you for proof of your licence (bar association and number) and suspend access until you provide it or if it is not current.
- Access is personal and non-transferable. Your password is yours alone: do not share it, not even with colleagues at your firm (each person needs their own access). If you think someone else knows it, let us know right away so we can revoke it.
5. What remains your responsibility
- Deadlines. The tool does not know the date on which you were served and does not track deadlines. You compute and control the deadline to file the appeal (art. 257 CPCCN) and the deadline for the complaint. If the tool mentions a deadline, it is only indicative.
- Form. You check that the brief meets the formal requirements set by the Court (Supreme Court Acordada 4/2007: length, cover page and other requirements).
- Citations. You verify every citation of case law, legal scholarship and statutes in an official source before using it (see section 6).
- Strategy. The decision to appeal, how to do it, or not to appeal is yours.
- Your client. You inform your client that you used an artificial intelligence tool to prepare the work, and you review the result thoroughly before delivering or filing it.
6. What the citation check does and does not verify
Every citation of the form «Fallos volume:page» appearing in an answer is automatically matched against an index of the official summaries of the Court's Case Law Secretariat. That check confirms that a published decision exists at that volume and page and what it is called; it does not confirm that it is relevant, that it says what is attributed to it, or that its doctrine is still good law. Nor does it cover citations of legal scholarship, statutes or other courts. A citation «not found» may not exist or may be missing from the index: in either case, do not use it without verifying it. Relevance is for you to decide on reading the decision.
7. What you may not upload
- Criminal or misdemeanour cases, or data on any person's criminal or misdemeanour record. The law reserves their processing to the competent public authorities (art. 7, para. 4, of Law 25,326).
- Sensitive data that is not needed (data revealing racial or ethnic origin, political opinions, religious, philosophical or moral beliefs, trade union membership, health or sex life: art. 2 of Law 25,326). If the argument needs it, upload only what is indispensable.
- Material you have no right to use, or any content for unlawful purposes.
Recommendation: anonymise. The method does not need to know who the parties are. Before uploading a judgment or a brief, replace names, ID numbers, addresses and other data identifying people with initials or their role («plaintiff», «defendant», «witness A»). During the beta, prefer working with public, already decided or anonymised cases.
8. Professional secrecy and confidentiality
- You decide what information about your client you upload. That decision is yours and is governed by your professional duties of secrecy and confidentiality.
- SPES is not your client's lawyer. Under these terms it assumes a contractual duty of confidentiality over everything you upload, which Law 25,326 also imposes on anyone involved in data processing (art. 10) and which remains in force after you stop using the service.
- SPES does not use the content of your cases for any purpose other than generating the answers you request: it does not sell it, transfer it, or use it for advertising or to train artificial intelligence models.
9. Personal data: SPES processes the data in your cases on your behalf
- With respect to the personal data appearing in the cases you upload, you are the controller and SPES provides the processing service on your behalf (art. 25 of Law 25,326). These terms are the contract for that service: SPES uses that data only to generate the answers you request, does not transfer it to anyone except the indispensable technical providers named below, and does not keep it once the service has been provided (today the conversation lives only in the server's memory; see the Privacy Policy).
- Providers involved (sub-processors):
- Anthropic, PBC (United States): processes messages and attachments with its artificial intelligence models, to generate the analysis and for the security check described in section 10. Under its commercial terms, it may not train models on that content.
- Render (United States): hosts the beta server.
- Google (United States): sends the alert email of section 10, which carries the name of the blocked person and a session identifier, never the content of the case.
- International transfer. Using the tool entails transferring the content you upload to the United States, a country not listed among those with adequate legislation recognised by the Argentine authority (art. 3 of DNPDP Disposition 60/2016). SPES is putting in place contractual clauses for these transfers following the models approved by DNPDP Disposition 60/2016 and AAIP Resolution 198/2023. Until those clauses are signed, the beta is to be used only with anonymised, public or test cases: do not upload identifiable personal data of third parties. The fact that the transfer takes place is another reason to anonymise.
10. Ownership of the tool and protection against probing
- The tool, its method, its internal instructions, its libraries and its code belong to SPES. We grant you a personal, non-exclusive and non-transferable licence to use it for as long as your access lasts.
- You may freely use what the tool produces for your cases in your professional practice; SPES claims no rights over your briefs.
- It is forbidden to attempt to obtain the tool's internal instructions, logic, architecture or model (for example, by asking it to show its instructions or to ignore its rules), to reverse-engineer it, or to use its results to build a competing product.
- An automated system, also based on artificial intelligence, reviews every message and the text of attachments to detect such attempts. The first time, the tool warns you and does not answer that request. The second time, your access is blocked and the administrator is notified by email. If you think it was a mistake, write to us at legal@spesjur.com.ar.
11. A beta: availability and retention
- The beta is offered as is, for testing. SPES does not guarantee that it will be available at all times or free of errors: it may be suspended for inactivity, restarted, changed or discontinued.
- The tool does not keep your cases. The conversation is lost when you press «Caso nuevo» (new case) or «Salir» (log out), and also when the server restarts. Save whatever is useful to you.
- SPES may shut down the beta or your access with reasonable prior notice, or without notice if you breach these terms. You may stop using it whenever you wish.
12. Liability
- SPES is liable for damage it causes through wilful misconduct or gross negligence. Nothing in these terms limits that liability, or any liability that cannot be limited by law (art. 1743 of the Civil and Commercial Code).
- Outside those cases, and to the extent permitted by law, SPES is not liable for damage resulting from using what the tool produces without the review described in section 5, from a deadline or formal requirement not checked, from court decisions, from information you uploaded without the right to do so, or from interruptions of the beta.
- If the protection of Consumer Protection Law 24,240 applies in your case, nothing in these terms restricts the rights it grants you (art. 37).
13. Cost
During the beta, use is free of charge. If SPES decides to charge for it, it will give notice in advance and nothing will be charged without your express acceptance of the new conditions.
14. Changes to these terms
SPES may modify these terms. Each version is dated. The new version is published on this page and on the access screen, and applies to you from the moment you accept it when you log in again. If you do not accept it, you may stop using the service.
15. Governing law and jurisdiction
These terms are governed by Argentine law. Any dispute is submitted to the courts of the Autonomous City of Buenos Aires, unless a mandatory rule provides otherwise.
